With new labor laws and regulations being enacted each year, staying up to date and compliant is always a challenge for HR management. And this is true for sick leave policies in California.

Surprisingly to some, unlike most other developed countries, the federal government here in the U.S. does not  require paid family or sick leave. The federal Family and Medical Leave Act (FMLA) does require eligible employers to provide unpaid family leave. But paid family leave and paid sick days are only required on the state and local levels.

Calling in sick is a normal part of being an employee. Complying with current paid sick leave labor laws is a normal part of your HR management tasks. Unfortunately, so is dealing with sick leave abuse.

The passage of California's Healthy Workplace, Healthy Family Act of 2014 (AB 1522), or Paid Sick Leave law, has had a significant impact on both employers and employees in California. It has been a challenge, especially for many smaller employers, to implement all the required procedures, notice postings, forms, and compliance verification.

California Paid Sick Leave Law Gets Clarification

With the confusing, and often overlapping, paid sick leave laws and regulations, employers find it difficult to be compliant with these California labor laws. 

Recently the California Labor Commissioner updated a few key points in its FAQ page. On March 29, 2017, the Commissioner, by way of the Division of Labor Standards Enforcement (DLSE), sought to provide additional guidance and clarification by issuing an update to its California Paid Sick Leave: Frequently Asked Questions.
