New Administration Not Favorable Towards DOL's Final Rule

The Trump White House recently instructed federal agencies to freeze all pending regulations. This action appears to include a number of labor and employment rules initiated under the Obama administration.

The Trump administration recently indicated that it was not favorable towards allowing former President Obama's expanded update of federal overtime pay rules. This was underscored by a court filing indicating that it may withdraw a White House appeal of a federal court's recent invalidation of the so-called Final Rule.

Employee Classification, Overtime, And The Final Rule

On December 1, 2016, the new Department of Labor (DOL) regulations, known as the "Final Rule”, went into effect and now dictates overtime pay and "exempt" employees’ status.

The Final Rule has now changed the employee classification of approximately 4.2 million workers nationwide for overtime pay by automatically qualifying them as "non-exempt" employees.  And in California, the DOL now requires all employers to adjust their policies with the "Final Rule."

New California Workers’ Comp Law And Excluded Employees

California Insurance Commissioner Dave Jones recently notified all workers’ comp insurers writing policies in the state about changes to procedures related to excluded employees created by a new law.
